Terms & Conditions

These terms govern your use of marketmenia.in and, alongside a signed proposal or scope of work, any engagement with MarketMenia India Pvt. Ltd. ("MarketMenia") for digital marketing, web & app development, enterprise technology, or domain & infrastructure services. By using this site or engaging our services, you agree to these terms.

1. Services

Specific deliverables, timelines, and pricing for any engagement are set out in a separate proposal, statement of work, or signed agreement between MarketMenia and the client. Where these terms and a signed agreement conflict, the signed agreement takes precedence.

2. Quotes and pricing

Published rates (e.g. on our pricing page) are indicative starting rates and may vary based on final scope. Custom quotes for marketing, development, and enterprise technology work are confirmed in writing before work begins. Prices are exclusive of applicable taxes unless stated otherwise.

3. Client responsibilities

• Providing timely access, content, credentials, and feedback needed to deliver the engagement on schedule.
• Ensuring you have the rights to any content, trademarks, or data you provide us to use in your project.
• Reviewing and approving deliverables within the timeframes agreed for your project.

4. Payments

Payment terms (deposits, milestones, or recurring billing for hosting/retainer services) are set out in your proposal or invoice. Hosting and domain services are billed in advance for the plan period selected; late payment may result in suspension of the affected service after reasonable notice.

5. Intellectual property

Unless otherwise agreed in writing, ownership of final deliverables (e.g. a completed website, custom CRM/CMS build) transfers to the client upon full payment. MarketMenia retains the right to reuse general methods, non-confidential know-how, and to display completed work in our portfolio unless a client requests confidentiality, in which case we anonymise the work as we've done for regulated-adjacent clients on this site.

6. Hosting and infrastructure services

Uptime, backup, and support commitments for hosting and infrastructure plans are as stated on our pricing page or your specific plan agreement. We are not liable for downtime caused by factors outside our reasonable control, including upstream provider outages, DDoS attacks, or force majeure events.

7. Limitation of liability

To the extent permitted by law, MarketMenia's total liability for any claim arising from our services is limited to the fees paid by the client for the specific service giving rise to the claim in the preceding three months. We are not liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate an ongoing engagement per the notice period set out in the relevant agreement. Fees for work completed up to the termination date remain payable.

9. Governing law

These terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts in New Delhi.

10. Changes to these terms

We may revise these terms from time to time; the "last updated" date above reflects the most recent revision. Continued use of our website or services after a revision constitutes acceptance of the updated terms.
